1. AGREEMENT TO TERMS
By requesting a quotation, placing an order, or otherwise engaging with Custom Carbon 3D ("we," "us," "our," or "the Company"), you ("Customer," "you," or "your") agree to comply with and be bound by these Terms and Conditions.
If you do not agree with any part of these Terms, you must not proceed with an order or use our services.
2. SERVICES OFFERED
Custom Carbon 3D provides professional additive manufacturing (3D printing) services based in Laval and Montréal, Québec, Canada. Our services include:
- Custom one-off parts — single-unit production from customer-supplied or internally designed files.
- Bulk & repeat orders — multi-unit or recurring production runs.
- Design + Print (full service) — we design your part from scratch and manufacture it. All designs created by us remain the exclusive intellectual property of Custom Carbon 3D.
- Print-only (customer-supplied files) — we manufacture from files provided by the Customer. The Customer is solely responsible for the accuracy, legality, and fitness of their submitted files.
We reserve the right to decline any order at our sole discretion, including orders for parts that may be used for illegal, dangerous, or unethical purposes.
3. ORDER PROCESS & QUOTATIONS
All orders begin with a quotation request submitted via our website or email at [email protected]. A quotation is not a binding contract; it is an estimate based on the information provided at the time of request.
An order is considered confirmed and binding only once:
- The Customer has reviewed and accepted the final quotation in writing (email confirmation is sufficient); and
- The required deposit has been received by Custom Carbon 3D.
Any changes to specifications, materials, or quantities after order confirmation may result in revised pricing and timelines. We will notify you of any such changes before proceeding.
4. PAYMENT TERMS
Custom Carbon 3D operates on a 50% deposit / 50% on completion payment structure:
- Deposit (50%): Due upon order confirmation. Production will not begin until the deposit is received.
- Final payment (50%): Due upon completion of the order, before pickup or shipment.
We accept payment via methods communicated at the time of invoicing. All prices are in Canadian Dollars (CAD) unless otherwise specified. Applicable taxes (GST/QST) will be added where required by law.
Failure to complete the final payment within 14 days of completion notice may result in storage fees or cancellation of the order without refund of the deposit.
5. CUSTOMER FILES & DESIGN SUBMISSIONS
When you submit a design file to Custom Carbon 3D for print-only services, you represent and warrant that:
- You own or have the legal right to use the submitted file;
- The file does not infringe any third-party intellectual property rights;
- The file does not contain anything unlawful, harmful, or intended for dangerous use.
You are solely responsible for the accuracy, completeness, and printability of files you submit. We are not responsible for defects arising from errors in customer-supplied files.
Customer files are stored securely using third-party cloud infrastructure (e.g., Google services or equivalent). We will not sell, share, or distribute your files to any third party for commercial resale or unrelated purposes.
6. INTELLECTUAL PROPERTY
Designs created by Custom Carbon 3D: All original designs, CAD files, concepts, and engineering work created by our team remain the exclusive intellectual property of Custom Carbon 3D. The Customer receives the physical printed part(s) only. No design files are transferred unless explicitly agreed upon in a separate written agreement.
Customer-supplied designs: You retain ownership of your original design files. As described in Section 5, we hold only a limited manufacturing licence. We will not resell, redistribute, or publicly share your digital files.
Physical reproductions: Regardless of whether a design originated from us or from the Customer, Custom Carbon 3D reserves the right to manufacture and sell physical parts that are identical or substantially similar to previously produced parts. This right applies only to the physical product and does not extend to reproducing or sharing the underlying digital design files submitted by the Customer.
Custom Carbon 3D, its logo, branding, website content, and all original materials are protected by copyright and trademark law. Unauthorized reproduction is prohibited.
7. PRODUCTION, TURNAROUND & DELIVERY
Turnaround times provided at quotation are estimates only and are not guaranteed. Production timelines depend on order complexity, material availability, print queue, and post-processing requirements.
We will communicate any significant delays as soon as they are identified. Delays do not entitle the Customer to cancel the order or withhold final payment.
Orders are considered complete when the Customer has been notified that the parts are ready for pickup or shipment.
8. SHIPPING & RISK OF LOSS
Custom Carbon 3D ships within Canada and the United States. Local pickup is available at our Laval / Montréal location by appointment.
Shipping costs are the responsibility of the Customer and will be added to the final invoice. All orders are shipped via reputable carriers; tracking information will be provided upon dispatch.
Risk of loss and title to the goods pass to the Customer upon handover to the carrier or upon local pickup. We are not liable for lost, delayed, or damaged shipments once in the carrier's possession. Customers are encouraged to request shipping insurance for high-value orders.
For orders shipped to the United States, the Customer is responsible for any applicable customs duties, import taxes, or brokerage fees.
9. REFUND & REPRINT POLICY
All products manufactured by Custom Carbon 3D are custom-made to order. Because of the bespoke nature of our work:
- All sales are final once production has commenced.
- No refunds are offered for change of mind, incorrect files or specifications provided by the Customer, or design choices made by the Customer.
- Deposits are non-refundable once production has started.
Defective parts: If a part is defective due to a proven manufacturing error on our part (e.g., incorrect material, structural failure under normal use, or significant dimensional inaccuracy not attributable to the submitted file), we will offer, at our sole discretion, one of the following remedies:
- A reprint of the affected part(s) at no additional cost;
- A repair or post-processing correction; or
- A partial or full credit toward a future order.
Claims for defective parts must be submitted within 7 days of delivery or pickup, accompanied by clear photographic evidence. We do not cover damage caused by improper installation, misuse, or conditions beyond the rated capabilities of the material used.
10. LIMITATION OF LIABILITY
Custom Carbon 3D produces parts for decorative, prototyping, and non-safety-critical applications unless explicitly agreed otherwise in writing. By placing an order, the Customer acknowledges and accepts the following:
- 3D printed parts may have inherent limitations in strength, heat resistance, and dimensional tolerance depending on the material and process used.
- The Customer assumes all risk associated with the use, installation, and application of parts manufactured by Custom Carbon 3D.
- Custom Carbon 3D shall not be liable for any direct, indirect, incidental, consequential, or special damages arising from the use, misuse, or failure of any part, including but not limited to property damage, personal injury, or vehicle damage.
- The Customer is solely responsible for ensuring that any part is appropriate for its intended application and complies with all applicable laws and safety standards.
To the maximum extent permitted by applicable law, our total liability to you in connection with any order shall not exceed the amount paid by you for that specific order.
11. ACCEPTABLE USE
You agree not to submit orders or files for parts that are intended to be used as weapons, that infringe on third-party intellectual property, that violate any applicable laws, or that are otherwise harmful or unethical. We reserve the right to refuse or cancel any order at any time if we reasonably believe it falls outside acceptable use. In such cases, any deposit paid may be forfeited.
12. GOVERNING LAW
These Terms and Conditions are governed by and construed in accordance with the laws of the Province of Québec and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
Any disputes arising from these Terms or any order placed with Custom Carbon 3D shall be subject to the exclusive jurisdiction of the courts located in the Judicial District of Laval, Québec.
13. CHANGES TO THESE TERMS
We reserve the right to update or modify these Terms and Conditions at any time. The updated version will be posted on our website with a revised "Last updated" date. Continued use of our services after any changes constitutes your acceptance of the revised Terms. We encourage you to review this page periodically.
